Regulatory Authority for Cosmetic Products in Vietnam

Cosmetic products in Vietnam are under the unified regulation of the Drug Administration of Vietnam (DAV), a subordinate body of the Ministry of Health of Vietnam (MOH). Its core responsibilities include receiving and processing cosmetic market access applications, conducting product compliance review, carrying out post-market supervision, and monitoring adverse reactions.Vietnam abides by the ASEAN Cosmetic Directive (ACD). Definition and Classification of Cosmetic Products

Vietnam adopts the unified ASEAN definition of cosmetics.Vietnam does not classify cosmetics into special cosmetics and general cosmetics, and all cosmetic products are administered under a uniform notification system.Definition of cosmetics: Any substance or preparation intended to be placed in contact with the external parts of the human body (or with the teeth and mucous membranes of the oral cavity), with the primary purpose of cleansing, perfuming, modifying appearance, correcting body odour, or protecting/maintaining them in good condition.

Prerequisites for Market Access

① Notarized Power of Attorney issued by the overseas manufacturer; ② Signed and sealed copy of the business registration certificate of the local importer in Vietnam; ③ Notarized Certificate of Free Sale (CFS) for the product; ④ Completed cosmetic application form (including product information, full ingredient formulation, etc.); ⑤ Quality management system documentation that meets the requirements of the ASEAN Cosmetic Directive; ⑥ Detailed information of the local agent and responsible person in Vietnam, as well as the importer and its responsible person; ⑦ Cosmetic compliance declaration documents; ⑧ Product labels and Product Information File (PIF) that comply with Vietnamese regulatory requirements.

Required Documentation for Notification Filing

Product Notification Form (completed in accordance with the unified ASEAN template).Letter of Authorization (LOA): Issued by the manufacturer/brand owner to authorize the responsible company in Vietnam, and shall be authenticated by the Vietnamese embassy or consulate.Certificate of Free Sale (CFS): Shall be authenticated by the Vietnamese embassy or consulate.Full Ingredient List (in INCI nomenclature, with the percentage of each ingredient specified).Product label artwork: Vietnamese language is mandatory (including instructions for use, precautions, and information of the responsible company).Copy of the enterprise’s Business Registration Certificate.Product Information File (PIF): Shall be prepared and kept on file. It is not required to be submitted together with the notification application, but shall be provided for inspection when required by the authority.

Notification Procedure, Timeline and Official Fees

Standard procedure: The enterprise registers an account on the system → completes and submits application materials online → pays the review fee online → receives the application processing result online.Detailed processing procedures of the DAV: ① After the submission of materials and payment of the fee, the DAV will confirm the receipt of materials within 1 working day; ② If the materials meet the requirements: A cosmetic receipt number will be issued within 3 working days; ③ If the materials fail to meet the requirements: A correction notice will be issued within 5 working days, and the applicant shall submit feedback within 5 working days. If the materials still fail to pass the review after correction, a rejection notice will be issued within 5 working days; ④ If no supplementary documents are received within 3 months from the date of issuance of the correction notice, the application will be automatically invalidated. The applicant shall re-submit the application and pay the fee again.

2.Notification Timeline and Official Fees

Official fee: 500,000 Vietnamese Dong per product (if applicable).Review timeline: 4 to 16 working days after the competent authority receives the fee. The specific processing duration is subject to actual conditions.
