Overseas medical device exports: labeling compliance serves as the first checkpoint for market access. Many manufacturers expanding into the Canadian market encounter customs clearance delays and postponed product launches due to incomplete label information or non-compliant language requirements. Today, we break down the core clauses of Canadian Medical Device Regulations SOR-98-282 related to labeling, clarifying mandatory information, language rules and special remedial solutions.

一、Mandatory Core Label Information

Canadian regulation states: No person shall import or sell a medical device unless the device bears a label showing all the information below:
  1. Device name
  2. Name and address of the manufacturer
  3. Device identifier: For systems, test kits, medical device groups or medical device families, identifiers shall also be provided for each component part.
  4. For Class III / IV devices: Control number.Important reminder: This refers to the label version number, NOT the registration number — a common source of confusion for enterprises.

  5. Description of package contents: Where contents of the package are not readily identifiable, specify specifications, net mass, length, volume or quantity.
  6. Sterility marking: Mark with the word “STERILE” if the device is to be sold in a sterile condition.
  7. Expiry date: Determined by the manufacturer based on the component with the shortest expected service life in the complete product.
  8. Intended use, indications and performance specifications: Must be marked if the intended use is not obvious to the intended user. Performance specifications shall also be included when necessary for proper use.
  9. Instructions for use (Two exemptions: decorative contact lenses; other medical devices that can be safely and effectively used without instructions.)
  10. Special storage conditions: Storage requirements applicable to the device.

Basic labeling requirement:All information must be legible, durable, prominent, and expressed in terms readily understood by the intended user.
二、Remedial Measures for Non-compliant Labels

If labels do not meet regulatory requirements at the time of import, importation is not automatically prohibited. Canadian regulation provides a relabeling pathway with strict deadlines and notification obligations:

Where the importer holds a medical device import licence, the importer shall submit prior notice to the Minister. If no import licence is held, prior notice shall be submitted by the manufacturer.

Hard deadline: Re-labeling complying with regulatory requirements must be completed within 3 months from the date of import, and finished prior to product sale.

Note:This clause is only a temporary remedial measure. It is strongly recommended that labels meet Canadian regulatory requirements at the factory stage, to avoid extra costs and control risks from secondary relabeling within Canada.
三、Other Key Points

(一)Packaging Rules for Devices Sold to the General Public

For medical devices sold to the general public, required information must appear on the outer packaging and be visible under normal sales conditions.

Exception: If the outer package is too small to accommodate all required information, the instructions for use may accompany the product separately. They do not need to be printed on the outer packaging nor visible during normal sales.
(二)Bilingual Requirements
General scenario: Information required under Section 21 may be shown in either English OR French. If only one official language version of instructions is supplied at the point of sale, the manufacturer shall provide the other official language version promptly upon request by the purchaser.
Critical point:For medical devices sold to the general public, the specified information must be marked in both English AND French.
This is the most frequent pitfall for exporting manufacturers. Language requirements differ greatly between B2B professional distribution channels and retail devices for end consumers. You must distinguish sales channels during label development.
四、Conclusion

Canadian medical device labeling rules contain many details. The English-French bilingual requirement for consumer-facing products and the control number requirement for Class III/IV devices are two high-frequency compliance pitfalls.
